Summary of Taiwan Tech Directives Regarding Procurements for Scientific and Technological Research and Development
The purpose of science is the discovery of new knowledge, and its progress is a process of trial and error. Research methods and tasks can be difficult to describe accurately in advance, and determining the human and material resources required for the research methods used or the possibility of success is nearly impossible, as is determining the success of specific research methods (referencing the minutes of the 16th plenary meeting of the fifth Session of the Sci-Tech and Information Committee of the fifth Legislature). To this end, Article 6, Paragraph 4 of the Fundamental Science and Technology Act maintains that unless otherwise prescribed by a treaty or agreement signed by Taiwan, any public school, public research institute (organization), or designated person or entity performing procurement for a project mentioned in Paragraph 1 of the same Act under a subsidy or commission from the government, or under a scientific and technological R & D budget prepared by a public research institute (organization) in accordance with the law, shall not be subject to the regulations of the Government Procurement Act. Due to the diversity of and flexibility required by scientific research, such R & D will be inevitably hindered by the general administrative framework provided by the Government Procurement Act. To encourage the prolific R & D capabilities of Taiwan Tech, a flexible regulatory system has been implemented to ensure scientific and technological R&D procurement can proceed smoothly, and these directives have been drafted in accordance with the Fundamental Science and Technology Act, the Regulations Governing Procurements for Scientific and Technological Research and Development, and a reference for entities drafting regulations on scientific R&D procurement.
